Terms of Service

These Terms of Service ("Terms") govern your access to and use of our mobile application ("FolioWise" or "App"), which is designed to help retail traders with limited time on stock market analysis quickly and easily adjust their portfolio allocations with periodic reminders. By using FolioWise, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By accessing or using FolioWise, you agree to comply with and be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you should not use the App.

2. Eligibility

You must be at least 13 years old to use FolioWise. By using the App, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms.

3. Account Registration

To access certain features of FolioWise, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account.

4. Use of the App

FolioWise grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use. You agree not to:

  • Use the App for any illegal or unauthorized purpose.

  • Modify, adapt, hack, or reverse engineer the App.

  • Interfere with or disrupt the App or servers or networks connected to the App.

  • Use the App in any manner that could damage, disable, overburden, or impair the App.

5. Portfolio Management and Reminders

FolioWise provides tools and reminders to help you manage your stock portfolio. However, you acknowledge and agree that FolioWise does not provide financial, investment, or legal advice. Any decisions you make regarding your portfolio are solely your responsibility. You should consult with a qualified financial advisor before making any investment decisions.

6. Fees and Payments

While FolioWise may be offered for free, certain features or services may be available for a fee. If you choose to use paid features, you agree to pay the applicable fees. All fees are non-refundable unless otherwise stated.

7. Intellectual Property

All content, trademarks, service marks, trade names, logos, and intellectual property rights in FolioWise are the property of Magic Llama Technologies, LLC, or its licensors. You agree not to reproduce, distribute, modify, or create derivative works from any content or materials available on the App without our prior written consent.

8. Termination

We may terminate or suspend your access to FolioWise, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

9. Disclaimer of Warranties

FolioWise is provided on an "as is" and "as available" basis. We disclaim all warranties, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, FolioWise shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the App; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party; or (iv) any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the App.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state of Delaware, without regard to its conflict of law principles.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
